Abstract:
Diese zweisprachige Veröffentlichung dokumentiert ein vom Max-Planck-Institut für ausländisches und internationales Strafrecht veranstaltetes Kolloquium. Dieses hatte zum Ziel, Unterschiede und Gemeinsamkeiten im Strafverfahrensrecht europäischer Länder im Hinblick auf eine verstärkte Zusammenarbeit innerhalb Europas auf dem Gebiet der Strafrechtspflege zu untersuchen. Die Beiträge von Wissenschaftlern und Praktikern aus 13 europäischen Ländern zu den fünf Themenbereichen "Prozesstypen", "Funktionen der Strafverfolgungsbehörden", "Faires Verfahren für den Beschuldigten", "Rolle des Gerichts im Ermittlungs- und Hauptverfahren" und "Konsensuale und andere entformalisierte Verfahrensarten" sowie die Diskussionsberichte zeigen nationale und internationale Entwicklungen in einem breiten Spektrum von Verfahrensordnungen auf. Sie wollen damit einen Beitrag zur Diskussion über eine mögliche Harmonisierung des Europäischen Strafverfahrensrechts und die zukünftige Kooperation der Strafverfolgungsbehörden in Europa leisten.
This German/English publication is based on the proceedings of a colloquium organized by the Max Planck Institute for Foreign and International Criminal Law. Participants at the colloquium examined the differences and similarities in criminal procedure laws of European countries in view of increasing European co-operation in the field of criminal justice. Articles, comments, and discussion summaries submitted by academics and practitioners from 13 European countries on the following five issues highlight national and international developments in relation to a broad spectrum of procedural rules: models of procedure; the role of the prosecution authorities; the accused's right to a fair trial; the role of the court in the investigation and trial phases; and non-formal types of procedure. This publication represents a contribution to the discussion concerning the possible harmonization of European criminal procedure law and the future character of co-operation among criminal prosecution authorities in Europe.
