Currently, it does not seem controversial to affirm that the omission of the obligor that serves to fulfill a second duty of equal or higher rank is not to be deemed unlawful in case of a conflict of duties. But, does the obligor who infringes a duty of rescue to undertake an unenforceable saving
behavior acts in accordance with the law? The work will attempt to answer this question affirmatively. In order to do this, we analyze what the specific deficit of this type of conflicts consists of and why the objective unenforceability of duty does not affect the rights of safeguarding of the needy. After defending the exclusionary nature of the unjust from the "deficit" collision of duties, this work concludes by solving the four basic structural variants of this institute of justification.
