Das Soziale Fortschrittsprotokoll ist eine vom Europäischen Gewerkschaftsbund erstmals 2008 formulierte und seither präzisierte Forderung. Sie reagiert auf die Rechtsprechung des Europäischen Gerichtshofs zum Verhältnis von Grundfreiheiten und kollektiven sozialen Rechten und fordert im Kern eine Ergänzung des europäischen Primärrechts, die bewirken soll, dass die sozialen Grundrechte im Kollisionsfall vorgehen. Der Beitrag unterstreicht die Berechtigung der mit dem Sozialen Fortschrittsprotokoll verfolgten Zielsetzungen und unterbreitet einen Vorschlag zur Weiterentwicklung. Der Vorschlag besteht aus zwei Teilen. Erstens wird angeraten, den Fokus auf den Wirkungskreis der europäischen Grundfreiheiten zu richten, statt eine generelle Vorrangstellung der kollektiven sozialen Rechte zu fordern. Zweitens rät der Beitrag, auf die Forderung nach einer Aktivierung der europäischen Gesetzgebung in Fragen des kollektiven Arbeitsrechts zu verzichten. Im Ergebnis schlägt der Beitrag eine im Sekundärrecht positionierte, an die Albany-Rechtsprechung des EuGH angelehnte Bereichsausnahme vor.

Revisiting the Social Progress Protocol of the European Trade Union Confederation
The Social Progress Protocol is a set of demands developed by the European Trade Union Confederation, formulated for the first time in 2008. It is a reaction to a set of European Court of Justice Decisions on the relationship between economic freedoms and social rights and demands a general primacy of social rights whenever they collide with economic freedoms. The article confirms that the ETUC demand goes in the right direction and suggests further improvement. The suggestion consists of two parts. First, the article proposes to ask for a change in the scope of the fundamental freedoms, rather than for a general primacy of social rights. Second, the article advises against making demands to create new Commission competencies in the field of labour law. In sum, the article is proposed an “Albany exception” that could be positioned in secondary rather than primary European law.
