Abstract

The Vertical Block Exemption Regulation regarding agreements between undertakings operating at different levels of competition, one of the most important instruments in European secondary antitrust law, is being reformed along with its corresponding guidelines. One of the key points of the revision is the more concrete and differentiated consideration of the increasingly important digital sector. The paper analyses the most important changes, shows where proposals have not been implemented and discusses possible implications for companies.

Die Vertikal-Gruppenfreistellungsverordnung für Vereinbarungen zwischen Unternehmen verschiedener Wettbewerbsstufen, eine der wichtigsten Instrumente im Europäischen Sekundärkartellrecht, wird samt zugehöriger Leitlinien reformiert. Zu den Schwerpunkten der Neufassung gehört die konkretere und differenziertere Berücksichtigung des immer wichtigeren Digitalsektors. Der Beitrag analysiert die wichtigsten Änderungen, zeigt auf, wo Vorschläge nicht umgesetzt wurden, und diskutiert mögliche Auswirkungen für Unternehmen.
